Æventyr 1 AS Terms and Conditions

Æventyr 1 AS/"Æventyr"/"us" with registered office at Markedsgata 6, 9510 Alta, Norway, acts as a supplier or agent to provide travel services in Norway.

The following Terms and Conditions apply from the conclusion of the contract between Æventyr or other companies in the Æventyr group and the client.

These Terms and Conditions govern the agreement between you, the client, and Æventyr. By booking accommodations and/or activities with us, you agree to these terms. Please read them carefully.

Æventyr may use service providers and sub-contractors ("Service Provider") and thus operate as an agent/reseller. Bookings through Æventyr, where Service Providers are used, are subject to both these Terms and the specific terms of the Service Provider. Please read the Service Provider's terms carefully as they may limit their liability.

When Æventyr operates as an agent/reseller, Æventyr is not responsible for any claims against the Service Provider.

Jurisdiction  


Æventyr is a Norwegian company operating under Norwegian law. Your booking and these terms shall be subject to Norwegian Law.

Payment


Payments for accommodations and/or activities are made through Æventyr 1 AS.

Full payment is required prior to the start of accommodations and/or activities.

Æventyr reserves the right to correct promotional or pricing errors at any time, or increase the price due to cost increases from applicable laws, airfares, cruise fares, currency fluctuations, taxes, or fuel surcharges.

If paying online via credit card, the site pricing is final (includes bank charges and applicable taxes).

Package Travels


Æventyr provides package travels and linked travel arrangements per the Norwegian Package Travel Act.

A package travel is a booking combining at least two travel services:
(a) accommodation
(b) transport
(c) vehicle hire, and/or
(d) other tourist services


A package travel arrangement must cover 24 hours or include overnight accommodation.

It is only a package travel if:
(i) bought in one booking;
(ii) offered, sold or charged at an inclusive or total price;
(iii) advertised or sold as a "package" or similar term;
(iv) combined after contracting, where the trader gives the traveler the right to choose among travel services; or
(v) purchased from several traders through linked online bookings, where the traveler's name, payment and email are transmitted between traders, and a contract with the last trader is concluded within 24 hours of booking the first service.

If you buy a combination of (a), (b) or (c) and (d) (a tourist service), this is only a package travel if the tourist services:


(i) are a significant proportion of the value, advertised as, or constitute a substantial element of the combination; or
(ii) are selected or bought before the performance of a travel service in (a), (b) or (c).

Æventyr also provides linked travel arrangements.

A linked travel arrangement is two travel services per (a), (b), (c) and (d), purchased for the same trip, with separate contracts with each provider, if the trader:
(i) facilitates separate selection and payment for each service during one visit or contact with their point of sale; or
(ii) facilitates in a targeted manner the purchase of at least one additional travel service from another trader, when a contract with the other trader is concluded within 24 hours of booking the first service.

If the linked travel combination is (a), (b) or (c) and (d) (a tourist service), it is a linked travel arrangement only if the tourist services are a significant proportion of the value, or advertised as or constitute a significant element of the combination.

The Norwegian Package Travel Act applies to package travel or linked travel arrangements provided by Æventyr.

In such cases, Æventyr will provide information on the main characteristics of the travel package, including:

- destination, route, stay duration, dates, number of nights
- transport means, type, category, places, dates, times of departure/return, intermediate stop places and durations, connections (approximate times provided if not yet determined)
- accommodation location, main features, category by country rules
- meals included
- visits, excursions or other services included in the total agreed price
- if not clear, whether any travel services are provided as part of a group and the approximate size if known
- language of services if traveler's benefit depends on effective oral communication
- if the trip is generally suitable for reduced mobility and precise suitability information upon request

Æventyr will also provide:
- business name, address, phone, email of the organizer and retailer
- total price with taxes, additional charges, fees, other costs (type of extra costs noted if can't be calculated before contracting)
- payment terms with deposit amount, percentage, schedule for the residual  
- minimum persons required for the package and deadline for cancellation if not reached
- passport, visa, health requirement information and periods to obtain visas
- the traveler's cancellation rights anytime pre-departure for a reasonable or standard fee
- optional or mandatory insurance
- the traveler's accepted special requirements

Reservations

 
You are responsible for filling booking documents accurately. Upon receiving your completed booking and full payment, Æventyr will confirm the booking of your selected accommodations and/or activities.

Confirmation and the booking ticket will be delivered within 24 hours of booking and payment. The contract between you, Æventyr and the Service Provider exists when this confirmation is received.

Special terms may apply to some promotions. Refer to the specific terms shown on promotion pages. By booking, you agree to the Terms herein and the Service Provider's applicable terms.  

By booking, you agree you read the Privacy Policy and will provide it to others on the booking.

By booking, you confirm you and others on the booking are the appropriate age, if age restrictions apply.

You are responsible for following safety instructions and recommendations. Æventyr isn't responsible for losses or damages from your failure in this regard.

You must ensure you and those you booked have all necessary travel documents (passports, visas, insurance, etc.).

Æventyr will operate all accommodations and/or activities as described in the booking confirmation, but reserves the right to modify or cancel any arrangements based on conditions. Material changes or cancellations may be made due to force majeure (war, riots, strikes, disasters, terrorism, etc.) or circumstances outside Æventyr's control. You will be notified and suitable alternatives proposed, if possible. If the alternatives are unacceptable, Æventyr will not refund any money paid.

Cancellation Policy


For individual travel bookings of Æventyr products:
- Over 7 days before departure: Free cancellation  
- 7 days or less before departure/no-show: No refund

For individual travel bookings with 3rd parties please refer to the cancellation policy of the third party.

For group bookings (15+ people) of all products:
- Over 60 days: No fee
- 30-59 days before activity/accommodation: 50% of total charged
- 29 days or less/no-show: No refund
- Size adjustments up to 3 people allowed up to 14 days before arrival. Later adjustments charged 100%.

Trip Cancellation Insurance:


To protect against financial loss, Æventyr strongly recommends trip cancellation insurance.

Æventyr will email/SMS guests and hotels if a trip must be cancelled for weather or unforeseen reasons. A full refund is given if rescheduling isn't possible.

Æventyr may refuse access to mentally/physically unfit guests who may be a safety hazard. The activity leader can remove a guest. No refunds or compensation are offered in these cases.  

Refund Policy


After receiving your cancellation email, Æventyr will verify and respond. If entitled to a full or partial refund per the timelines above, Æventyr will request your banking details.

Allow a minimum of 10 business days for refunds after Æventyr receives your cancellation email.

Guarantees  


Æventyr doesn't guarantee whale or Northern Lights sightings on applicable tours, though chances are high. Æventyr will do its utmost to spot them.

Medical Issues


Consider the nature of the accommodations and/or activities and ensure you're fit to participate.

Advise Æventyr in writing before booking of any conditions requiring medication or special equipment. You're responsible for bringing such items. Not all of our offerings are wheelchair accessible.

Insurance


You are responsible for obtaining full travel and health insurance for yourself and ensuring the same for all persons you book.

Complaints and Claims


Æventyr will address claims or complaints brought to its attention as soon as possible and within 7 days of the event. Provide sufficient details and evidence for investigation.  

Æventyr isn't liable if you fail to lodge a complaint within this time limit.

Liability Exemption


Æventyr isn't liable and won't compensate you if its obligations are hampered by events beyond its control, including injury, loss, damage, death, delay, or inconvenience from force majeure (war, riots, government actions, terrorism, strikes, weather, epidemics, dangers of travel, etc.).

While facilitating Service Provider services, Æventyr isn't responsible for services beyond its control. You agree Æventyr isn't responsible for wrongful/negligent acts, omissions, or failures of transportation, tour, cruise, hotel, or 3rd party suppliers. By using Service Providers, you'll look to them for claims and not hold Æventyr liable.

However, Æventyr may assist you without obligation in notifying a Service Provider of your claim against them.

Delays

Æventyr is not responsible for any damages, losses, or delays if a guest (individual traveler) arrives late for the scheduled start of a program, activity, accommodations, or other services, even if the delay is caused by force majeure events outside of the guest's control, such as flight delays/cancellations, road closures, extreme weather conditions, or other unforeseen circumstances. It is the guest's responsibility to allow sufficient time to arrive on schedule, considering the possibility of travel disruptions. Refunds will not be provided for any portions of the services missed due to a guest's late arrival.
